CHERY REWARDS PRIVACY POLICY

 

1. Introduction

The Chery Rewards Program (the “Program”) is operated by AusArm Pty Ltd (T/A Partner+) (ABN 56 664 315 048) (“Partner+”) as a service provider to Chery Motor Australia (the “Program Sponsor”).

For the purposes of the Privacy Act 1988 (Cth) (including the Australian Privacy Principles) (“Privacy Act”):

  • Chery Motor Australia is the data controller in relation to Personal Information collected through the Program.

  • Partner+ acts solely as a data processor/service provider, processing Personal Information on behalf of and in accordance with the instructions of Chery Motor Australia.

References in this Privacy Policy to “Chery Rewards”, “we”, “us”, or “our” refer to Chery Motor Australia as data controller, unless otherwise specified.

This Privacy Policy explains how Personal Information is handled in connection with the Program.

 

2. What is Personal Information?

“Personal Information” has the meaning given in the Privacy Act. In general terms, it means information or an opinion about an identified individual or an individual who is reasonably identifiable.

 

3. Acceptance of this Policy

By accessing or using the Program website (www.cheryrewards.com) or participating in the Program, you acknowledge that your Personal Information will be handled as described in this Privacy Policy.

This Privacy Policy forms part of the Chery Rewards User Agreement.

 

4. Role of Partner+

Partner+ provides technology, administration, fulfilment coordination, and support services to Chery Motor Australia in relation to the Program.

Partner+:

  • Processes Personal Information only on behalf of Chery Motor Australia;

  • Does not determine the purposes or means of processing Personal Information;

  • Acts only in accordance with contractual arrangements and instructions from Chery Motor Australia; and

  • Implements reasonable security measures in relation to the Personal Information it processes.

 

5. Personal Information Collected

Personal Information may be collected directly from you, or provided by Chery Motor Australia, in connection with the Program.

Depending on the features enabled by Chery Motor Australia, this may include:

  • Name

  • Gender

  • Postal address

  • Email address

  • Telephone number(s)

  • Occupation or employment information

  • Country of residence

  • Date of birth or age

  • Identification details (where required for specific rewards such as travel)

  • Transaction or redemption information

  • Device identifiers (such as IP address)

  • Website usage information

  • Communications or enquiries submitted by you

Chery Motor Australia determines what Personal Information is required for the Program. Partner+ processes only the information necessary to provide the Program services.

 

6. Sensitive Information

Where a Program feature requires sensitive information (for example, certain travel or event arrangements), Chery Motor Australia will determine the lawful basis for collection (including obtaining consent where required).

Partner+ processes such information only where instructed and only to the extent necessary to deliver the relevant Program service.

 

7. How Personal Information is Collected

Personal Information may be collected:

  • When you register or log in to the Program;

  • When you update your profile;

  • When you redeem rewards;

  • When you contact support;

  • When Chery Motor Australia provides participant information to enable Program participation.

Certain information (such as IP address, browser type, pages visited and access times) may be automatically collected for system administration, security, and analytics purposes.

 

8. Cookies and Analytics

The Program website uses cookies and similar technologies to support functionality, security, and user experience.

Cookies may:

  • Enable login functionality;

  • Maintain session information;

  • Support analytics.

Third-party analytics providers (such as Google Analytics or Adobe Analytics) may collect information in accordance with their own privacy policies.

You may disable cookies in your browser settings; however, some website functionality may be unavailable.

 

9. Purpose of Processing

Chery Motor Australia collects and uses Personal Information for purposes including:

  • Administering the Program;

  • Managing membership accounts;

  • Recording performance and points accrual;

  • Facilitating reward redemption;

  • Communicating program updates;

  • Providing customer support;

  • Complying with legal obligations.

Partner+ processes Personal Information solely to deliver these services on behalf of Chery Motor Australia.

 

10. Marketing Communications

Program-related communications (such as account notices, reward confirmations, and updates) may be sent as part of Program administration.

Where marketing communications are enabled by Chery Motor Australia, they will be sent by or on behalf of Chery Motor Australia and will include an unsubscribe mechanism where required by law.

Partner+ sends communications only as a service provider and in accordance with Chery Motor Australia’s instructions.

 

11. Disclosure of Personal Information

Personal Information may be disclosed:

  • To Reward Suppliers for fulfilment of rewards;

  • To service providers engaged to host, support, or operate the Program;

  • To professional advisers;

  • Where required or authorised by law.

Partner+ discloses Personal Information only as necessary to deliver Program services and in accordance with Chery Motor Australia’s instructions.

Partner+ does not sell Personal Information.

Reward Suppliers and third-party providers operate under their own privacy policies. Partner+ does not control and is not responsible for their privacy practices.

 

12. Overseas Processing

Personal Information is primarily processed in Australia.

Where required to support the Program, Personal Information may be processed by service providers located outside Australia.

Chery Motor Australia is responsible for ensuring that any overseas disclosures comply with the Privacy Act.

Partner+ implements contractual and operational measures reasonably required to support compliance obligations.

 

13. Security of Personal Information

Partner+ implements reasonable technical and organisational measures designed to protect Personal Information it processes on behalf of Chery Motor Australia.

Security measures may include:

  • Encrypted connections (SSL/TLS);

  • Access controls;

  • Secure hosting environments;

  • Firewalls and monitoring tools.

However, no method of transmission over the internet is completely secure.

 

14. Payment Information

The Program does not require Partner+ to collect or store payment card details such as credit or debit card numbers.

Where payments are required, they are handled via methods determined by Chery Motor Australia and/or relevant third-party payment providers. Partner+ processes only the information necessary to support transaction records and fulfilment.

 

15. Data Breaches

If Partner+ becomes aware of a suspected or actual data incident involving Personal Information processed on behalf of Chery Motor Australia, Partner+ will notify Chery Motor Australia promptly.

Chery Motor Australia is responsible for assessing notification obligations under the Notifiable Data Breaches scheme and other applicable laws.

Partner+ will provide reasonable assistance in responding to and investigating data incidents.

 

16. Access and Correction

Requests to access or correct Personal Information should be directed to Chery Motor Australia.

Partner+ will provide reasonable assistance to Chery Motor Australia in responding to such requests.

Members may update certain profile details directly via their Program account.

 

17. Retention of Personal Information

Partner+ retains Personal Information only for as long as necessary to provide Program services and as required by contractual or legal obligations.

Where information is no longer required, reasonable steps will be taken to delete or de-identify it in accordance with Chery Motor Australia’s instructions and applicable law.

Backup copies may be retained securely for limited periods consistent with standard IT practices.

 

18. Children

The Program is not intended for individuals under 18 years of age unless expressly authorised by Chery Motor Australia.

Where participation by persons under 18 is permitted, it must occur in accordance with any requirements determined by Chery Motor Australia (including any required parental or guardian consent).

 

19. Links to Third-Party Websites

The Program website may contain links to third-party websites.

Partner+ and Chery Motor Australia are not responsible for the privacy practices or content of third-party websites. Users should review the privacy policies of those websites.

 

20. Changes to this Privacy Policy

Chery Motor Australia may update this Privacy Policy from time to time.

Updated versions will be published on the Program website and will take effect upon publication unless otherwise stated.

PROGRAM PERIOD

The 2026 Chery Rewards Sales Incentive Program will commence 1st January and conclude on 31st December 2026 (12 months).

 

ELIGIBLE PARTICIPANTS

a) Eligible participants are Chery Sales Managers, Sales Consultants employed at an authorised Chery Dealership in Australia.

b) Chery Dealership Dealer Principals and General Managers are not eligible to earn rewards in this Program. However, a General Manager who is also the Chery Sales Manager at an authorised Chery Dealership is considered to be an eligible participant.

c) Participation in the Chery Rewards Program means acceptance of these Terms and Conditions.

 

EARNING REWARD POINTS

Eligible participants can earn valuable reward points for eligible vehicle sales each month subject to the following:

a) The “How To Earn” section in the Program portal outlines how to earn reward points and forms part of the Terms & Conditions of this program.

b) Participants must be employed at an eligible Chery Dealership at the time reward points are awarded to be eligible for rewards.

c) Chery Motor Australia reserves the right to add additional reward point opportunities throughout the program to suit the needs of the business as Chery Motor Australia sees fit.

 

PROGRAM REWARD POINTS

Reward Points will be allocated within 7-10 business days following month-end in the Chery Rewards website and via email each month. The results published will be final, binding and cannot be disputed by any dealership or participant.

 

REDEEMING REWARD POINTS

Reward Points earned may be redeemed for merchandise prizes and experiences from the rewards catalogue on the Chery Rewards website. Rewards cannot be exchanged for cash or other benefits. Reward Points are not transferable to another participant, may not be redeemed by another participant and may not be pooled with another participant’s points for combined credit. Unredeemed reward points expire 30 days after the end of the program, or immediately after a participant leaves a Chery dealership. If a participant’s employment is terminated by a Dealer, unredeemed reward points will expire immediately.

 

EVENTS AFFECTING SALES

Chery Motor Australia does not expect that any participant’s potential in this program would be materially affected by a Dealership's operating capacity. Should a participant dispute their achievement of KPIs or reward points earned at any time during the program period, Chery Motor Australia has complete discretion when determining if the participant has any justification for such a dispute.

 

Any request/s to receive credit for sales that may have been incorrectly reported must be emailed to: programhq@cheryrewards.com with your General Manager’s authorisation no later than 15 days after month-end; after this time, all results will be considered "final" and no further correspondence will be entered into. However, any of the following will not be agreed to by Chery Motor Australia, as justification for a dispute:

i. The inability of Chery Motor Australia to supply eligible vehicles, eligible parts or accessories, or any relevant KPI data within the program period;

ii. The existence of any unfavourable marketing conditions; or

iii. Failure of a dealership, for any reason whatsoever, to sell a particular vehicle.

Should there be any change of circumstances or adverse conditions which, in the sole opinion of Chery Motor Australia, materially alter participants’ ability to earn rewards, then this program may be deferred or cancelled at Chery Motor Australia’s discretion and without obligation of any kind.

 

NEW PARTICIPANTS/TERMINATIONS

a) New participants in the Chery Rewards Program are automatically enrolled by Chery Motor Australia. It is not the responsibility of individual Chery Dealerships to notify the Chery Rewards of new sales personnel or staff changes.

b) New sales personnel are eligible to earn reward points commencing in their first month of employment at a Chery Dealership in that role.

c) Participants who transfer to another Chery Dealership will be entitled to retain all reward points earned year-to-date at the discretion of Chery Motor Australia.

d) If a participant leaves a Chery Dealership, unredeemed reward points will expire immediately after their employment ceases. If a participant’s employment is terminated by a dealership, unredeemed reward points will expire immediately.

 

CHANGE OF OWNERSHIP

If the Dealership changes ownership during the program period, but remains a Chery Dealership, it shall be deemed a condition of the transaction that the benefits of Chery Rewards are maintained. Any participant retaining employment with the new owner will retain eligibility to participate in the program. If a dealership changes ownership and does not remain a Chery dealership, unredeemed reward points at the time of change of ownership will expire immediately.

 

TAX LIABILITY

Chery Motor Australia reserves the right, at its sole discretion, to reimburse or not reimburse Chery Dealerships for any Fringe Benefits Tax (FBT) that may apply to rewards offered through this program. If reimbursement is considered, the Dealership must provide confirmation of FBT payment to the ATO, along with relevant audited financial documentation.

 

Chery Motor Australia will not reimburse any dealership where there has been false reporting or a breach of any Terms and Conditions.

 

All Dealerships and participants are strongly encouraged to seek independent advice regarding FBT, other taxation liabilities, and the implications for their individual tax situations.

 

DISQUALIFICATION

Chery Motor Australia reserves the right to disqualify any participant found to be fraudulent or not adhering to Chery Motor Australia approved business practices. Failure by a dealership or participant to observe and comply with these Terms and Conditions may result in disqualification at the sole and absolute discretion of Chery Motor Australia.

 

AUDIT

Chery Motor Australia reserves the right to conduct an audit of any participating dealership to verify sales eligibility and compliance with the rules & conditions of this program.

 

FINAL DECISION

Chery Motor Australia reserves the right at any time, in its sole and absolute discretion, to the fullest extent permitted by law, to disqualify any participant, or modify, amend, suspend, extend, terminate or cancel the Chery Rewards Program, or any part of it without prior notification. The decision of Chery Motor Australia shall be final and binding in all matters and no correspondence will be entered into regarding its decisions.

 

WARRANTIES AND RELEASES

Chery Motor Australia and Chery Rewards shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained as a result of taking of the prizes redeemable under the Chery Rewards Program, except for any liability which cannot be excluded by law. Chery Motor Australia and Chery Rewards also make no warranties or representations either express or implied and expressly disclaim any/all liabilities with respect to type, quality, standard or fitness or suitability for any purpose of the rewards.

 

14. SUSPENSION, CANCELLATION OR VARIATION OF THE PROGRAM

Chery Motor Australia reserves the right to amend any part of this program, extend or terminate the program, vary the reward points earned, or amend any of the Terms and Conditions of the program at any time, at Chery Motor Australia’s absolute and sole discretion, without prior notification to any party involved.

 

15. ADMNISTRATION

The program administration will be handled by Partner+ (Chery Rewards).
